Hiring, working with and dismissing staff is much easier in Switzerland than in most other European countries. However, there are a number of issues to consider in order to take advantage of the comparatively liberal labour market in a lawful and advantageous manner.
Firstly, the legal basis must be clarified. One example of this is checking whether the company is subject to a collective labour agreement, as is the case for certain industries. If this is the case, requirements such as minimum wages or other work-related minimum standards (work clothing, safety, notice periods, etc.) should be observed.
In international situations, e.g. if employees are not domiciled in Switzerland, do not have Swiss citizenship or perform more than 25% of their working time outside Switzerland, (e.g. in a home office/telework environment), specific regulations apply and foreign law may also apply.
Due to the complexity of human resources management, it is advisable to seek advice from experts and, at least in the initial phase, to have the administration undertaken by an external agency.
